Los desarrollos actuales del escepticismo moderno han representado unresurgimiento de algunas de los problemas presentados por Descartes en laPrimera Meditación. Dentro de estos desarrollos son de especial interés lasreconstrucciones del escepticismo cartesiano apoyadas en el principio decierre lógico bajo implicación conocida del concepto. Estas reconstruccionespermiten desembarazar al escepticismo cartesiano de presupuestosontológicos y metafísicos y permiten, además, ver cierta continuidad conel escepticismo pirrónico. Este trabajo cuestiona el supuesto carácter intuitivo o natural del escepticismo acerca del mundo externo. En §1 examinamos una versión del argumento escéptico que se sostiene a partir de dos principios: clausura del conocimiento e indiferencia. Para profundizar la postura que ha defendido Michael Williams, en §2 ofrecemos un examen novedoso de la argumentación escéptica cartesiana que nos permite establecer que en dos argumentos de esta estrategia argumentativa resulta claro que la presunta naturalidad que el escéptico reclama es falsa y (...) que, antes bien, para lograr su conclusión, necesita asumir compromisos con el realismo epistémico, es decir, con la tesis de que nuestras creencias se ubican al interior de una jerarquía epistemológica de acuerdo únicamente con su contenido y en abstracto. Finalmente, basados en argumentos de inspiración wittgensteiniana, en §3 mostramos cómo es que, en contra del realismo epistémico, cada creencia desempeña un papel justificativo según el contexto pertinente. The purpose of the paper is to cast doubt on the alleged intuitive or natural character of the skeptical argument about the external world. In §1, we examine a version of the skeptical argument based on the epistemic closure principle and the indifference principle. In §2, in order to deepen the view defended by Michael Williams, we offer a novel examination of the Cartesian skeptical argumentation to show that it is clear that the alleged naturalness claimed by the skeptic is (...) nowhere to be found in two arguments which can be found in such argumentative strategy; moreover, to reach her conclusion, the skeptic needs to commit to epistemological realism, namely, the claim that each of our beliefs belongs to an epistemological hierarchy based solely on its content. In §3, based on arguments inspired by Wittgenstein, contra epistemological realism, we show how each belief has a justificatory role based on its context. (shrink)

Este artículo presenta el concepto de derecho desde diferentes ópticas, cada una de ellas con sus particularidades y la influencia que tienen en la actualidad en los ordenamientos jurídicos. El derecho no es un concepto fácil de entender, pero la forma en que se debe aplicar hoy día debe cobijar no solo la aplicación de la norma o enunciados normativos, sino componentes de índole moral, como los principios, todos ellos en pie de igualdad. No se trata de establecer una jerarquía (...) en los elementos jurídicos y morales, sino un criterio en el cual la corrección del ordenamiento jurídico lleve a la Justicia. Este texto parte de un método hermenéutico dialéctico, y tiene como finalidad ir construyendo un concepto de derecho que cumpla con los estándares de la corrección y la razonabilidad, como principios básicos para cumplir con la igualdad y la justicia. La retórica como técnica responsable de la inteligibilidad del discurso, de los modos y espacios de enunciación, de los propósitos y de los públicos, definió, hasta el siglo XIX, la existencia de los llamados géneros literarios devenidos en historia, literatura y periodismo, hoy áreas claramente diferenciadas. Sin la retórica la desmembración de los géneros literarios es incomprensible; se quedan de lado aspectos como las tradiciones narrativas, editoriales y didácticas que delimitaron los procedimientos de escritura, la implementación de formatos que contribuyó (...) a perfilar usos, públicos y apropiaciones, y la disposición de representaciones sobre el quehacer de historiadores, periodistas y literatos. Este artículo explora la situación que enfrentaron los llamados realistas durante la Independencia en la Nueva Granada y su lenguaje de amor y subordinación al rey, a través del cual ratificaban su pertenencia a la comunidad política española, aun habiendo nacido en América. El rey no era un símbolo lejano, sino una presencia sentida y vivida por sus vasallos americanos. Las guerras de Independencia no enfrentaron, como lo adujo la historiografía tradicional, a criollos y peninsulares, sino a miembros de un (...) mismo cuerpo político, quienes por mantenerse leales a la corona o haber nacido en la península, fueron convertidos en enemigos a exterminar, tal como se dispuso en el Decreto de guerra a muerte de 1813, expedido por Simón Bolívar. Internacionalmente, la historiografía colombiana es conocida y recordada por un sugerente trabajo de Germán Colmenares titulado Convenciones contra la cultura: ensayos sobre la historiografía hispanoamericana del siglo xix. Quienes han incursionado en este tipo de estudios se ven enfrentados a su lectura obligatoria, así como a tomar posición respecto a la tesis “discursiva” del colonialista en el estudio de las historias patrias hispanoamericanas. La historiadora antioqueña Patricia Cardona no ha sido la excepción, aunque a lo largo de su trayectoria (...) académica ha venido mostrando otros caminos para pensar y hacer la historia de la Historia en el país. Desde sus trabajos sobre la enseñanza de la lectura en el período federal, esta autora acudió a las herramientas de la historia de la cultura escrita para incorporar el estudio de la materialidad, los públicos, los espacios y las prácticas de consumo de los materiales impresos. Law search is fundamental to legal reasoning and its articulation is an important challenge and open problem in the ongoing efforts to investigate legal reasoning as a formal process. This Article formulates a mathematical model that frames the behavioral and cognitive framework of law search as a sequential decision process. The model has two components: first, a model of the legal corpus as a search space and second, a model of the search process that is compatible with that environment. The (...) search space has the structure of a “multi-network”—an interleaved structure of distinct networks—developed in earlier work. In this Article, we develop and formally describe three related models of the search process. We then implement these models on a subset of the corpus of U.S. Supreme Court opinions and assess their performance against two benchmark prediction tasks. The first is to predict the citations in a document from its semantic content. The second is to predict the search results generated by human users. For both benchmarks, all search models outperform a null model with the learning-based model outperforming the other approaches. Our results indicate that through additional work and refinement, there may be the potential for machine law search to achieve human or near-human levels of performance. (shrink)

Historical re-enactment is an emerging social practice in the knowledge society, and it helps us better understand aspects of the past and heritage. The knowledge gained through historical recreation contributes to the construction of quality citizenship. The deepening of democratic values requires that educational systems commit to the promotion of critical citizenship. Service-learning constructively develops experiences that connect science, education and society. Our research describes a systematized praxis of historical recreation. Landscapes are shaped over time by the changing imaginaries that result from new representations of nature and the value associated with it. This paper discusses the evolving discourses which have shaped the perception of the landscape in two socially and ecologically significant contexts in Chile. The first is the central-southern region of the country, a large portion of which is now devoted to commercial forestry plantations. The second is the Patagonia-Aysén region, where since the 1990s, colonisation of a land defined (...) by a tradition of livestock rearing has evolved into a process epitomised by the slogan “Aysén, Life Reserve”. The representation that was made of central-southern Chile in the 50 'and 60' as a deforested and degraded land was the justification for promoting a new form of land occupation: the monoculture forest, designed and executed by a specific law. Forty years on from the passing of this law, the plantations of central-southern Chile have undergone a process of naturalisation. In this case, the exaltation of nature has been permanent. The only thing that changes is the definition of nature, which ended up including forest plantations. In Patagonia-Aysén, by the other side, there has been a marked shift in the rhetoric surrounding land. This has been particularly noticeable in the case of government bodies and private ecotourism companies, which have constructed an imaginary in line with a new model of economic development for the area. In a break with tradition, both the public and private sectors are beginning to shift their investment away from agricultural and livestock exploitation and towards ecotourism and conservation projects. In both cases, we analyse the manner in which transformations in perceptions and representations of landscape bring about new forms of land use, and how new focuses of value and social interest, forged within wider environmental discourses, have brought with them unexpected social consequences, like depopulation, economic transformations, cultural changes, etc. Thus, the aim of this work is to expose and discuss the reality and scope of new green discourses and their influence on the perception of natural landscapes in the Chilean neoliberal context. Offering a contemporary perspective on the theory of modernity that differentiates it from its predecessors, this reconstruction has been expanded to include a fourth instrumental aspect. In addition to the recognition of the three parts of traditional modernity—freedom, equality, and solidarity—that follow the basic ideas of the constitutional revolutions of the 18th century, this updated vision introduces responsibility. Concerning itself with what the sociology of development, risk, and ecological crisis have added to these classical ideas, the addition of the fourth (...) part, responsibility, seeks to recognize the experiences of successive eras, and the 20th century in particular. Recently, Brass and Dix showed 143–165) that the well founded semantics WFS can be defined as a confluent calculus of transformation rules. This led not only to a simple extension to disjunctive programs 167–213), but also to a new computation of the well-founded semantics which is linear for a broad class of programs. We take this approach as a starting point and generalize it considerably by developing a general theory of Confluent LP-systems CS . Such a system CS is a (...) rewriting system on the set of all logic programs over a fixed signature L and it induces in a natural way a canonical semantics. Moreover, we show four important applications of this theory: most of the well-known semantics are induced by confluent LP-systems , there are many more transformation rules that lead to confluent LP-systems , semantics induced by such systems can be used to model aggregation , the new systems can be used to construct interesting counterexamples to some conjectures about the space of well-behaved semantics. O nosso intuito é problematizar o ensino da filosofia como uma disciplina a ser aprendida. Pretendemos desta forma, trazer questões que possam auxiliar a nossa investigação para uma solução coerente e satisfatória. Para isso, retomaremos alguns conceitos gregos de educação, focando-nos no séc. V a.C. através da tragédia e da sofística para demonstrar a influência destas dentro daquilo que chamamos educação. Se tomarmos o mestre como o artífice e o discípulo como objeto deste ensino, devemos ter em mente que a (...) arte de ensinar é conveniente ao discípulo e não ao mestre. O mestre, portanto, é instrumento para que se possa ensinar tal arte ao discípulo. O objetivo deste trabalho é refletir o ensino, seu instrumento e seu objeto com o intuito de repensar o caminho da filosofia na educação. This paper presents the Obstetric and Neonatal Ontology (OntONeo). This ontology has been created to provide a consensus representation of salient electronic health record (EHR) data and to serve interoperability of the associated data and information systems. More generally, it will serve interoperability of clinical and translational data, for example deriving from genomics disciplines and from clinical trials. Interoperability of EHR data is important to ensuring continuity of care during the prenatal and postnatal periods for both mother and child. As (...) a strategy to advance such interoperability we use an approach based on ontological realism and on the ontology development principles of the Open Biomedical Ontologies Foundry, including reuse of reference ontologies wherever possible. We describe the rationale for an application ontology covering the domain of human body fluids that is designed to facilitate representation, reuse, sharing and integration of diagnostic, physiological, and biochemical data, We briefly review the Blood Ontology (BLO), Saliva Ontology (SALO) and Kidney and Urinary Pathway Ontology (KUPO) initiatives. We discuss the methods employed in each, and address the project of using them as starting point for a unified body fluids ontology resource. This lack of systematization concerning the use and definition of terms poses problems for physicians and biomedical professionals. Roger Garaudy é um filósofo francês que muda de uma posição inicialmente marxista para outra existencialista. A sua aproximação com o existencialismo se dá na década de 70 quando o pensador foi expulso do Partido Comunista Francês por discordar dos rumos do marxismo de então. Ao mesmo tempo ele descobre no existencialismo a chave teórica que justifica sua preocupação humanista. Da fase marxista, o filósofo preserva os elementos éticos e as preo­cupações sociais que ele transfere para sua filosofia existencial. Garaudy (...) espera com eles resol­ver os problemas de uma subjetividade que cresceu além da conta nos tempos modernos, ques­tão que lhe parece outros existencialistas não haviam ainda resolvido. Neste texto também mostramos como o filósofo considera a superação da facticidade, o que dá especificidade à sua reflexão. A complexidade e criatividade de suas formulações nos mostram uma das muitas possibilidades do existencialismo, movimento que precisamos bem balancear neste início do século XXI porque ele traduz as inseguranças e incertezas do homem do último século. RESUMEN Introducción: La dimensión ambiental constituye un proceso esencial en la formación de profesionales, de modo que en el desempeño de su profesión puedan educar hacia el desarrollo sostenible a las futuras generaciones. Objetivo: Representar en un modelo pedagógico la lógica de la dimensión ambiental en la formación laboral investigativa de los profesionales en la universidad. Materiales y métodos: Se utilizaron métodos teóricos, empíricos y matemáticos-estadísticos. Resultados: Elaboración del modelo pedagógico de dimensión ambiental en la formación laboral investigativa de los (...) profesionales en formación. El modelo está estructurado en tres subsistemas: uno teórico, se centra en la integración de saberes pedagógico ambientales a partir de las relaciones que se establecen entre sus componentes, otro metodológico, el cual resume la proyección ambiental de la formación laboral investigativa y un subsistema procedimental, que manifiesta la instrumentación transformadora ambiental que debe ocurrir en los estudiantes. El modelo aporta una cualidad sinérgica que le imprime identidad, totalidad y contribuye a su autodesarrollo. Conclusiones: Con la elaboración del modelo se revelan nuevas interpretaciones que se manifiestan como relaciones teóricas funcionales surgidas entre los componentes de los subsistemas que lo integran y a la vez, entre los subsistemas como macro componentes. La validación del modelo resultó estadísticamente significativa, mediante la instrumentación de una estrategia pedagógica para la dimensión ambiental en la formación laboral investigativa. ABSTRACT Introduction: The environmental component is an essential process in the training of professionals, that enables them to educate future generations towards sustainable development. Objective: To represent in a pedagogical model the logic of the environmental dimension in the research training of professionals. Materials and methods: Theoretical, empirical and mathematical-statistical methods were used. Findings: The development of the pedagogical model of environmental dimension in research and labor training of professionals. The model is structured in three subsystems: the first focuses on the integration of environmental pedagogical knowledge from the relationships established between its components; the second is of a methodological character and summarizes the environmental projection of research training; whereas the third one is procedural, expressing the environmental transformative instrumentation that must occur in students. The model provides a synergistic quality that consolidates identity, totality and contributes to its self-development. Conclusions: With the elaboration of the model new interpretations are revealed that are manifested as functional theoretical relations arising between the components of the subsystems that integrate it and at the same time, between the subsystems as macro components. The evaluation of the model was statistically significant, through the instrumentation of a pedagogical strategy for the environmental dimension in the research and labor training. (shrink)

By measuring the level of CSR communication carried out by hotels located in the Colombian Caribbean region and identifying the main determinant factors influencing this level (including pressure from the different stakeholders), this paper contributes to deepening our understanding of the antecedents of CSR communication in small and medium‐sized enterprises (SMEs) operating in emerging economies and, particularly, in the hotel industry, for which no previous studies on this topic could be uncovered. The results reveal that the level of CSR disclosure (...) is low in the region and that the size of the hotel, the pressure from government agencies, and the age and educational background of the hotel’s top manager have a significant influence on the level of CSR communication. Results indicate a reactive approach to CSR communication confirming the prominent role played by government agencies, thus contributing to gain a richer understanding of institutional influences on CSR in Latin American countries. In terms of practical implications, findings suggest that governments should play a more active role in stimulating CSR communication in emerging countries, particularly in the case of SMEs. This chapter defends a deflationary, or ‘quietist’ account of causation in science. It begins by laying out the elements of four central philosophical theories of causation, namely the regularity, counterfactual, probabilistic and process accounts. It then proceeds to briefly criticise them. While the criticisms are essentially renditions of arguments that are well-known in the literature, the conclusion that is derived from these is new. It is argued that the limitations of each of the theories point to a deflationary or quietist (...) approach to causation in science. The practical focus is on interventionist methods for causal inference in physics and biology, and on the extant debates within the philosophy of each discipline as to how best to approach such methods. It is then argued that none of the four central theories proposed can completely explain or reduce the methods of causal inference that appear in each science. Yet, each theory provides partial insights into some of the grounds of causal inference and causal discovery. It is consequently suggested that we should retain the various methodological lessons without committing expressly to any metaphysics of causation. (shrink)

This article examines the future of social security in emerging economies, exploring the key challenges facing these countries and proposing potential solutions. Financial sustainability, universal coverage and equity are some of the main obstacles that must be overcome to ensure a robust and fair social security system. Through a literature review and case analysis, proposals are presented to improve the effectiveness and sustainability of these systems in the context of emerging economies.

We present a causal model for the EPR correlations. In this model, or better framework for a model, causality is preserved by the direct propagation of causal influences between the wings of the experiment. We show that our model generates the same statistical results for EPR as orthodox quantum mechanics. We conclude that causality in quantum mechanics can not be ruled out on the basis of the EPR-Bell-Aspect correlations alone.

Weber's piece on the development of the north-European Western city has not commanded attention in the recent theoretical literature. This article argues that it can however provide fresh insights into some key problems of Weber's diagnosis of modernity and into his general sociological theory, especially as to his theory of action and creativity. A more open-ended conception of modernity can be gained from its analysis, which is more compatible with Weber's own methodological assumptions. Finalmente se considera a contribuição de Esteves Pereira nos estudos que fez da história das ideias em Portugal e no Brasil, destacando sua contribuição nos colóquios Antero de Quental e Tobias Barreto nas quase três décadas em que se estende esse trabalho. The paper studies the contribution of Joaquim de Carvalho, a teacher at the University of Coimbra in the first half of last century, to the phenomenological movement in Portugal. Its importance is not restricted to the introduction he had prepared for the Portuguese translation of The Philosophy of rigor as science. He used the lessons of Edmund Husserl to build a critique of Hegelian and positivist conceptions in his work History of Philosophy. It also draws on phenomenology to treat problems (...) such as homesickness. All these aspects of the project as publisher of phenomenology in Portugal, especially in education. (shrink)

This text aims at pointing out some of the philosophy of law present in the works of the Hellenist philosopher and physician Sextus Empiricus (ΣΕΞΤΟϒ ΕΜΠΕΙΡΙΚΟϒ), and supports two main theses: the first, based on an epistemological point of view, presupposes that exact knowledge of the world — that is, an entirely adequate relationship between the mind of each human being and the events around — is not possible, which insurmountably renders all perception relative. The second thesis, from an axiological (...) point of view, postulates that Skepticism does not necessarily imply disregarding concepts of justice or abandoning any ethical parameters, but functions as an immunizing element against intolerance and dogmatism. Modernity brought with it the insistence on these ideas and the divorce of science and faith does not seem to stop. The present article proposes in a dialogue with John Henry Newman to recognize the proper place of positive science regarding religious faith, presenting the epistemological distinction, or the way of understanding the knowledge that makes of faith a plausible and possible path that has its Own epistemic structure directed towards the credibility of religious faith. The purpose of this paper is to present a formalization of the language, semantics and axiomatization of justification logic in Coq. We present proofs in a natural deduction style derived from the axiomatic approach of justification logic. Additionally, we present possible world semantics in Coq based on Fitting models to formalize the semantic satisfaction of formulas. As an important result, with this implementation, it is possible to give a proof of soundness for $\mathsf{L}\mathsf{P}$ with respect to Fitting models.
